Instagram Giveaway Rules

1. Company organizing the draw
The organizing entity of this draw is the company Sociedad Microcooperativa Artilezko Nomadak with registered office at San Andres 4, 31422 Zorokiain, Navarra, Spain

2. Purpose of the draw
The purpose of this giveaway is to reward users who participate in this Artal giveaway on the Instagram account @artal.eus for their loyalty.

3. Geographical scope and participants
These promotions are valid nationwide in Spain.

4. Temporal scope
The promotion period will begin on May 11th at 12:00 PM and will end on May 20th at 8:00 PM. It will only take place through the Instagram account of @artal.eus and in compliance with these legal terms and conditions.

5. Participants
Participation in this promotion is free and voluntary for residents of Spain aged 18 and over, who are registered on Instagram with a single, real user account. Participants must actively engage in the draw according to the rules outlined in this document. Employees of Artal and any direct or indirect collaborators involved in the promotion or printing of related materials, as well as their immediate family members, are not eligible to participate.

Should such a circumstance arise, Artal will automatically disqualify these entries. Artal is not responsible for the accuracy of the data provided by participants, nor for being unable to contact participants and/or winners if the data provided is incorrect or contains errors.

This promotion aims to ensure that all participants compete on a level playing field and in strict accordance with the principles of good faith. Therefore, Artal reserves the right to automatically and immediately exclude any participant who violates the principles of good faith, engages in dishonest or inappropriate conduct, uses fraudulent means, or breaches these Terms and Conditions in any way. Should any irregularities be detected after the awarding of prizes, Artal reserves the right to take appropriate legal action against the perpetrator, including, but not limited to, actions aimed at recovering the prizes.

7. Promotion Mechanics
From the first day of the promotion until the last day inclusive, Instagram followers of @artal.eus can participate in this giveaway via Instagram, provided they meet the above requirements. Point 6.

8. PRIZE
The prize will be a €100 voucher to spend on Artal products of the winner's choice.

9. Prize Awarding Mechanics
It will be through the AppSorteos platform, it will be a random draw.
The winner authorizes the publication of their Instagram name on Artal's social media. The winner will be notified via a comment on the giveaway photo. If the winner fails to comply with the rules of this giveaway or cannot be contacted within the timeframe stipulated in these terms and conditions, the prize will be forfeited.

Participants must not include comments that offend or are likely to offend morality, ethics, good taste, or decorum, nor comments that infringe, violate, or violate intellectual or industrial property rights. We must warn you of the consequences and liabilities you may incur if you make illicit or fraudulent use of these rights. Artal will act immediately upon any complaint or suspicion of intellectual property rights infringements, or any content that may be considered inappropriate, and will proceed to remove it immediately, potentially requesting the permanent blocking of the infringing user.

Artal declines all responsibility for the consequences that the voluntary, consented and deliberate display by the user of his comments may have on himself, his family, friends and/or relatives, or other third parties.

10. Contact with the winner
The winner will be contacted on May 21st via a comment on the giveaway image, through a story on the @artal.eus account, and via direct message from Artal to arrange prize delivery. The winner must contact Artal within 3 days to complete the communication. If Artal does not receive a response within three days, including all the necessary information for prize delivery, the prize will be forfeited.
If any winner fails to respond within the specified timeframe, Artal reserves the right to select a new winner, following the procedure described in this article. If this new winner also fails to respond, Artal may declare the prize void.

11. Disassociation from Instagram
Instagram does not sponsor, endorse, or administer this promotion in any way, nor is it associated with it. The user completely disassociates themselves from Instagram and acknowledges that they are providing their information to Artal, not Instagram. The information provided will only be used to process the participant's entry and to notify them of the prize should they be selected as a winner. The user completely disassociates themselves from Instagram.

12. Taxation
The holding of the planned draw, as well as the awarding of the prize, are subject to current tax regulations.

13. Acceptance of the terms and conditions
Participation implies full acceptance of these terms and conditions. Any expression of non-acceptance will result in the participant's exclusion, and consequently, Artal will be released from any obligation to that participant. By accepting the prize, the winner assumes all expenses incurred, except those expressly included in the promotion, as well as any liability arising from the collection and use of the prize. In this regard, the winner will be responsible for all applicable taxes and expenses not specifically mentioned in these terms and conditions.

14. Intellectual Property Rights
The @artal.eus account reserves the right to use the names and images of the winning participants as well as all participants for advertising purposes in any media it deems appropriate and without explicit notification.

15. Personal data
In accordance with the Organic Law on the Protection of Personal Data and the Law on Information Society Services and Electronic Commerce.

16. Applicable law and competent courts
The law applicable to this promotional draw is Spanish law, and the courts competent to hear any conflict or controversy are the Courts of the city of Pamplona.
